The Federal High Court in Umuahia has dismissed two suits filed by former Abia State lawmakers, Hon. Kalu Chikwendu and Hon. Apugo Chukwudi, against the Independent Corrupt Practices and Other Related Offences Commission (ICPC).
The lawmakers had challenged the ICPC’s authority to investigate them over corruption allegations, claiming that Section 28 of the Corrupt Practices and Other Related Offences Act, 2000, was unconstitutional.
The court ruled that the ICPC has the statutory power to investigate corruption-related offences and that Section 28 is constitutional.
The suits were deemed an attempt to evade lawful investigation, and the court awarded ₦500,000 costs against each plaintiff.
The ICPC can now proceed with its investigation into the allegations against the former lawmakers.
