{"id":18361,"date":"2017-10-20T12:24:06","date_gmt":"2017-10-20T11:24:06","guid":{"rendered":"https:\/\/nationalwire.com.ng\/?p=18361"},"modified":"2017-10-20T12:24:06","modified_gmt":"2017-10-20T11:24:06","slug":"nimasa-faults-nlngs-demand-315m-judgment-debt","status":"publish","type":"post","link":"https:\/\/nationalwire.com.ng\/sub\/nimasa-faults-nlngs-demand-315m-judgment-debt\/","title":{"rendered":"NIMASA faults NLNG\u2019s demand for $315m judgment debt"},"content":{"rendered":"<p class=\"m_2900301182900872582ydpdd7783f8MsoNormal\">The Nigerian Maritime Administration and Safety Agency (NIMASA), has appealed the judgment\u00a0of the Federal High Court Lagos in the matter between Nigeria Liquefied Natural Gas (NLNG), Attorney General of the Federation, Global West Vessels Specialists Ltd and NIMASA.<\/p>\n<p class=\"m_2900301182900872582ydpdd7783f8MsoNormal\">\u00a0In a statement\u00a0<span class=\"aBn\"><span class=\"aQJ\">on Thursday<\/span><\/span>, NIMASA explained that it filed the appeal with an application to stay the execution of the judgment and restrain NLNG, pending the determination of the appeal.<\/p>\n<p class=\"m_2900301182900872582ydpdd7783f8MsoNormal\">\u00a0NIMASA said: \u201cThe appeal and stay was filed even before receiving the Certified True Copy of the judgment 14 days after the judgment was delivered in line with legal provisions. This proactive step of the Agency was taken to forestall any negative action, yet the NLNG ignored this court action and commenced a media trial.<\/p><div data-ad-id=\"32665\" style=\"text-align:center; margin-top:0px; margin-bottom:0px; margin-left:0px; margin-right:0px;float:none;\" class=\"afw afw_ad_image afw_ad afwadid-32665  \">\r\n                                                            <div style=\"font-size:10px;text-align:center;color:#cccccc;\">Advertisement<\/div>\r\n\t\t\t\t\t\t\t<a target=\"_blank\" href=\"http:\/\/www.accessbankplc.com\" rel=\"nofollow\"><img decoding=\"async\" height=\"auto\" max-width=\"100%\" src=\"https:\/\/nationalwire.com.ng\/wp-content\/uploads\/2019\/06\/Banner-1.jpg\"><\/a>\r\n                                                                        \r\n\t\t\t\t\t\t\t<\/div>\n<p class=\"m_2900301182900872582ydpdd7783f8MsoNormal\">\u00a0\u201cIn the grounds of Appeal by NIMASA\u2019s legal team, the Agency complained that the learned trial Judge erred when in breach of NIMASA\u2019s constitutional and fundamental right to fair hearing refused to consider and pronounce on its arguments, on the issues for determination and its counter claim filed in opposition to the amended originating summons.<br \/>\n\u201cIt also complained\u00a0 that the learned trial Judge erred in law in entertaining and granting the reliefs contained in NLNG\u2019s amended originating summons wrongly used to commence the proceedings without converting it to a writ of summons, ordering pleadings and calling on the parties to lead oral evidence to prove their cases since their affidavits were irreconcilliably in conflict.<br \/>\n\u201cThe Legal team noted that the above grounds led to the error of the court which occasioned miscarriage of justice to NIMASA.<\/p>\n<p class=\"m_2900301182900872582ydpdd7783f8MsoNormal\">\u00a0\u201cNIMASA however stated that the demand of 101 billion Naira from it as the judgment debt by the NLNG, after becoming aware of the Agency\u2019s appeal is wrong and considered an affront to Nigeria\u2019s judicial system.\u00a0 NLNG should allow the law take its full course and stop the media trial of a dispute that is before the court\u201d.<\/p>\n<div class=\"m_2900301182900872582ydpdd7783f8MsoNormal\">\u00a0According to the Director General of the Agency, Dr. Dakuku Peterside, \u201cWe feel there is an orchestrated publicity campaign to wrongly sway public opinion on the judgment.
