A Chief Magistrate Court sitting in Bosso Local Government Area of Niger State has ordered for the remand of a former Commissioner in the state, to a Minna Correctional Centre.
The erstwhile Commissioner Alhaji Mohammed Abubakar Katcha, was standing trial on a count charge which bordered on Intentional Insult to Provoke a breach of public peace, an offence which contravened section 399 of the penal code.
According to the First Information Report ( FIR), made available in Court and obtained by the National Wire , one Isah Lakpene of Opposite Aloevera Hotel in Minna, reported to the Tudun Wada Police Division under the state Police Command, on the 19th December, 2019, that ” you Mohammed Abubakar Katcha of House No.2, besides Himma College in Minna, called him on his Telephone and raining series of abuses on him over a reason best known to you” .
The Police Prosecutor an Assistant Superintendent of Police[ASP} Abdullahi Maiyaki, told the court that during police investigation the former Commissioner admitted committing the offence and pleaded for forgiveness.
However, when the charge was read to him by the presiding Chief Magistrate AlhAJI Ibrahim Swasu Shabafu , he pleaded not guilty to the charge.
At this Point, the Police prosecutor {ASP} Abdulahi Mayaki, objected to the bail of the former Commissioner on the ground that he was an habitual offender who was standing trial on similar offence before a Minna Chief Magistrate Court No2.
He told the Court that granting him bail at this point he will commit similar offence my Lord. I strongly objected to his bail. I Urged the court to remand him in Minna Custodian Centre. he told the court.
The Defence Counsel to the accused, Barrister Mahmud Mohammed made an oral application for his client’s bail and the Chief Magistrate advised that he should come through formal application and adjourned the case to 6th, January, 2019, for further mentioned and ordered for the remand of the former Commissioner in Custodian Centre.
